Terms and Conditions

Sale and Purchase of Goods
Made in Banaras ("Seller") agrees to sell, and you ("Buyer") agree to purchase, the goods as described and specified at the time of checkout ("Goods") on the terms and conditions outlined in this Agreement. The description and quantity of the Goods will be incorporated by reference from the checkout window ("Checkout").

Purchase Price
The Buyer agrees to pay the total purchase price for the Goods as specified on the website during checkout. This price is inclusive of any applicable charges unless otherwise stated.

Payment Terms
The full purchase price of the Goods is due at the time of purchase, as indicated at Checkout. If payment is not received by the due date, the Seller reserves the right to pursue legal remedies and seek reimbursement for any collection costs, including attorney's fees, legal costs, and other associated expenses.

Delivery
Delivery will be made in accordance with the Seller's shipping policy in effect on the date of shipment, unless otherwise agreed in writing. Estimated delivery dates are provided for guidance purposes only, and while the Seller will make reasonable efforts to adhere to them, timely delivery cannot be guaranteed. The Goods will be packaged in accordance with the Seller's standard practices unless otherwise agreed.

Customs, Duties, and Taxes
It is the responsibility of the recipient to ensure that the product can be lawfully imported into the destination country. The recipient is considered the importer of record and must comply with all applicable laws and regulations.
For orders shipped outside of India, customs duties, taxes, and fees may apply based on the destination country. However, all shipments from Made in Banaras are currently sent on a Delivery Duty Paid (DDP) basis, meaning no additional duty or taxes are required at the time of delivery.
In the rare event that duties or taxes are levied after shipment, please contact us, and we will assist in resolving the matter.
Customs policies vary, so we recommend the recipient contact their local customs office for guidance. If customs clearance procedures are required, it may result in delays beyond the original delivery estimate. If requested, the recipient may need to provide additional documentation, such as a social security number, tax ID, or proof of address, to clear the shipment.

Disclaimer of Warranty / Limitation of Liability
Made in Banaras makes no warranty or representation regarding the quality or fitness of the Goods for any specific purpose unless expressly stated in this Agreement. The Seller disclaims all other warranties, whether express or implied, to the fullest extent permitted by law.

Colour Disclaimer
Due to differences in screen displays, the actual colour of the Goods may vary slightly from what is shown on your monitor. Factors such as monitor calibration, screen settings, and lighting conditions during photography may contribute to these discrepancies.

Price Disclaimer
While we strive to provide accurate descriptions and prices for all our products, Made in Banaras reserves the right to refuse the sale of any item if it is found to be incorrectly priced.

Force Majeure
Made in Banaras will not be held liable for any failure or delay in performance if such failure or delay is caused by circumstances beyond the Seller's control, including but not limited to government actions, strikes, fires, natural disasters, or the inability to obtain necessary materials or resources. In such cases, the Seller will make reasonable efforts to mitigate any impact on performance.

General

• This Agreement is binding upon the Buyer and the Seller, and neither party may assign their rights or obligations without the express written consent of the other.
• If there is any conflict between this Agreement and other documents relating to the Goods, this Agreement shall take precedence.
• No modification, amendment, or alteration of this Agreement shall be valid unless agreed to in writing by the Seller.
• If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• This Agreement will be governed by the laws of Varanasi, UP, India, without regard to its conflicts of law rules. Any disputes arising from this Agreement will be resolved exclusively in the courts located in Varanasi, India, and the Buyer consents to such jurisdiction and venue.
